This Agreement governs your relationship with Household Properties and its staff, your use of the Household Properties Website, Management Websites and Social Media Sites (“the Website”) and services provided by Household Properties.

These are the current terms and conditions and replace any other terms and conditions previously published on this site. Your continued use of this site and Household Properties services constitutes Your agreement to this Agreement and any modifications to it. Household Properties may amend, update or change these terms and conditions from time to time by publishing them on the Website, without prior notice to you. You should periodically check the page containing these terms and conditions for changes.

1. SCOPE OF HOUSEHOLD PROPERTIES SERVICES

1.1 Household Properties operates a real estate agency, provides asset management, and facilitates this in part using an online website at https://www.HouseholdProperties.com.au and other online property management software, and social media portals that provides the public, property owners and/or their authorised representatives (“Owners” or “You“) the opportunity to engage our team or any of its related bodies corporate, affiliates, joint venture partners, and any directors, employees or agents of such entities registered or affiliated with Household Properties (“Agents”) who provide professional services (“Services”) and third-party service providers who provide industry related products and services (“Providers”).

1.2 A reference to User in this Agreement includes Owners, Agents and any other person that visits or views the Website.

1.3 Household Properties facilitates the interaction between You and its Agents.

1.4 Household Properties has no obligation to assist You or involve itself in any way in any dispute between You and a Provider.

1.5 Household Properties will provide you with support in regard to the functionality of the Website and provision of other Household Properties services.

2. HOUSEHOLD PROPERTIES SERVICE DESCRIPTION

2.1 Services provided by Household Properties will be reviewed and updated from time to time. In addition to the points set out below, certain portion(s) of these services may be separately described on the Website.

2.2 To obtain Services or Provider products or services You will send an enquiry through our contact us page.

2.3 You can request an appraisal or lodge any number of request options provided.

2.4 You are free to negotiate the fees to suit your circumstances with the Property Manager, provided however the fees payable by You in respect of the Services must be agreed between You and the Household Properties prior to You appointing Household Properties to provide the Services for your property.

2.5 If You appoint Household Properties to provide the Services, an Agreement as updated by the REINSW ill be prepared and entered into and a request for information will be made. This is a form that collects information critical for the generation of an Exclusive Management Agency Agreement (“Management Contract”) between You and Household Properties including but not limited to your representative details (if applicable), the relevant bank account, appointment date, tenancy options, service and maintenance conditions, disclosure of information to tenants, council, water, strata, strata manager, insurance and solicitor details.

2.6 Once Household Properties accepts your appointment, You agree to accept the Services fees agreed to.

2.7 By signing in hard or soft copy, or by electronically signing the Management Contract, You and Household Properties will be deemed to have entered into a separate, legally binding agreement under which You agree to purchase, and Household Properties agrees to provide You with the Services under the terms and conditions stated in the Management Contract.

2.8 By signing a Management Contract electronically You agree to be bound by the electronic signing provider’s terms and conditions.

2.9 Household Properties Provider products and services are offered to You pursuant to the terms and conditions offered by the third party. Provider products and services may be promoted on the Website to You. We take no responsibility for the support of these products and services by the Provider.

2.10 If You engage with any Provider, the agreement will be directly between the You and that Provider (“Provider Contract”).

3. FEES

3.1 Registering your information through a contact form with Household Properties is free. There is no charge for You to request an appraisal or related property advice.

3.2 If You appoint Household Properties for your property via the Website, You agree to pay the Services fees as set out in the Management Contract.

3.3 You acknowledge that Household Properties may pay a Referral Fee for receiving information regarding You, enabling Household Properties to identify You or otherwise causing You to be introduced to Household Properties (“Referral Fee”). Household Properties is required to pay the Referral Fee to the referrer through its referral program “Refer and Earn” and you have no liability toward Household Properties in this regard.

3.4 Provider products and services must be purchased directly by either You or Household Properties on your behalf for the Provider Fee (as updated from time to time). Household Properties receives commissions from Brokers, Utility connection providers, and Landlord Insurance providers.

3.5 Invoices for Provider products and services purchased appear as deductions on your monthly statement. These costs are deducted from rents or if there are insufficient funds you agree to forward funds to cover the shortfall within 7 days.

4. PAYMENT, REFUNDS, AND CREDIT

4.1 Once Household Properties commences the Services in accordance with the Management Contract, You will pay Household Properties from rental income the fees stated in the Management Contract or as otherwise agreed in writing.

4.2 If You are genuinely dissatisfied with the performance of Household Properties in delivering the Services since the commencement date of the Management Contract, Household Properties will add your communication to a complaint register and, subject to (1) below refund 100% of the Management Service fees already received for the month in which it was first identified that the service was not satisfactorily provided, to your nominated bank account. It will do this on the proviso that (1) You explain how Household Properties has not delivered so you can afford Household Properties the opportunity to improve its services for the benefit of all its customers.

5. LANDLORD INSURANCE

5.1 Household Properties does not give insurance or financial advice but may offer You an opportunity to obtain landlord insurance. All such insurance is offered by a third party.

5.2 By purchasing landlord insurance you acknowledge and agree that you have read and understood the Product Disclosure Statement. Should you decide to purchase this Provider product for your investment property, it is implied that you give authority to Household Properties to initiate a policy on your behalf.

5.3 You may ask for a policy to be canceled at any time and return your policy (including a renewal) if you are not happy with it. This does not affect your cancellation rights in the Policy or rights to a refund when you have a double insured. However, you cannot return your Policy if you have exercised any right under the Policy (e.g. a claim has been made) or your rights have ended (e.g. the period of insurance has finished).

5.4 Household Properties does not represent that the landlord insurance offered is adequate or appropriate for You. You must make your own enquiries about whether any further insurance is required.

6. OWNER OBLIGATIONS

6.1 You agree that at all times:

  • (a) You will comply with this Agreement and all applicable laws and regulations that apply to You as an Owner, or in relation to any other way(s) that You use the Website and Household Properties services;
  • (b) You will use clear, complete and accurate information to complete your Household Properties Management Contracts and Provider Contracts;
  • (c) You will make all necessary enquiries and satisfy yourself as to whether Household Properties or a Provider meets your requirements and objectives, including in relation to your requirements in ownership of a property;
  • (d) You will perform all your obligations to other Household Properties Users under a Management Contract, Provider Contract and to Household Properties under this Agreement;
  • (e) all content on the Household Properties Website may not be used on third-party sites or for other business purposes without Household Properties prior permission;
  • (f) You must not use the Household Properties Website for any illegal or immoral purpose.

6.2 Any information posted on the Household Properties Website must not, in any way whatsoever, be potentially or actually harmful to Household Properties or any other person. “Harm” includes, but is not limited to, economic loss that will or may be suffered by Household Properties. Without limiting any provision of this Agreement, any information You supply to Household Properties must be up to date and kept up to date and must not:

  • (a) be false, inaccurate or misleading or deceptive;
  • (b) be fraudulent or involve the sale of counterfeit or stolen items;
  • (c) infringe any third party’s copyright, patent, trademark, trade secret or other proprietary rights or intellectual property rights, rights of publicity, confidentiality or privacy;
  • (d) violate any applicable law, statute, ordinance or regulation (including, but not limited to, those governing export and import control, consumer protection, unfair competition, criminal law, antidiscrimination and trade practices/fair trading laws);
  • (e) be defamatory, libellous, threatening or harassing;
  • (f) be obscene or contain any material that, in Household Properties sole and absolute discretion, is in any way inappropriate or unlawful, including, but not limited to obscene, inappropriate or unlawful images; and
  • (g) contain any malicious code, data or set of instructions that intentionally or unintentionally cause harm or subverts the intended function of any Household Properties Website.

6.3 When You enter into a Management Contract or Provider Contract using the Household Properties Website You create a legally binding contract with another Household Properties User unless the transaction is prohibited by law or by this Agreement. If You do not comply with your obligations to another Household Properties User, You may become liable to that other User. If another User breaches any obligation to You, You – not Household Properties – are responsible for enforcing any rights that You may have with that User.

6.4 If Household Properties determines at its sole discretion that You have breached any obligation under this Cause, it reserves the rights to remove any content, Posted Brief or review You have submitted on the Website.

7. THIRD PARTY CONTENT & LINKS

7.1 The Website may include links to third-party sites which are not related to Household Properties and in relation to which Household Properties has no control or interest. The appearance of those links on this site does not indicate any relationship between Household Properties and that third party or any endorsement by Household Properties of that third party, its site or the products or services which it is advertising on the Website.

7.2 The information on the Website is provided ‘as is’, without express or implied warranty. The inclusion of any link does not imply that we endorse the linked site. You use the information and links at your own risk.

8. PRIVACY

8.1 Household Properties Privacy Policy applies to all Users and forms part of this Agreement. Use of the Website confirms that You consent to, and authorise, the collection, use, and disclosure of your personal information in accordance with Household Properties Privacy Policy.

8.2 Household Properties third-party service providers will provide their service pursuant to their own privacy policy. Prior to acceptance of any service from a third-party You must review and agree to their terms of service including their privacy policy.

9. NO WARRANTY

9.1 Household Properties makes no representation or warranty as to the Provider product or services.

10. INDEPENDENT CONTRACTORS

10.1 Household Properties confirms that all products and services provided by Providers promoted on the Website are provided solely by such Providers. To the extent permitted by law, You agree that Household Properties has no liability to You for any loss or damage incurred by You in any manner due to the performance or non-performance of such Providers.

11. SERVICE OF NOTICES

11.1 Except as stated otherwise, any notices must be given by registered ordinary post or by email, either to Household Properties’ contact address as displayed on the Household Properties Website or to Household Properties Users’ contact address as provided at registration. Any notice shall be deemed given:

  • (a) if sent by email, one (1) business day after the email is sent, unless the Owner is notified that the email address is invalid or the email is undeliverable, and
  • (b) if sent by pre-paid post, four (4) Business Days after the date of posting, or on the seventh Business Day after the date of posting if sent to or posted from outside Australia. In this clause, “Business Day” means a day on which banks are open for general business in Sydney, New South Wales, other than a Saturday, Sunday or public holiday.
  • (c) Notices related to the performance of any Provider service must be delivered to such Provider as set out in the third party Provider terms and conditions.

12. TERMINATION

12.1 Either party may terminate a Management Contract at any time for any reason.

12.2 You may cancel your Management Contract at any time by notifying us via email at

. We will then use our best efforts to cancel your account within thirty (30) days of our receipt of your request.

12.3 To terminate a lease agreement refer to Tenancy FAQs and Notices above.

12.4 Termination of this Agreement by either party does not affect any Provider Contract that has been formed between Household Properties Users on your behalf. If you have entered into a Provider Contract, You must comply with the terms of that contract including charging and paying the fees as applicable.

12.5 Termination of this Agreement by either party does not affect your obligation to pay any outstanding fees still owing to Household Properties for Household Properties services provided prior to termination.

13. GENERAL

13.1 This Agreement is governed by the laws of New South Wales, Australia. You and Household Properties submit to the exclusive jurisdiction of the courts of New South Wales, Australia.

13.2 The provisions of this Agreement are severable, and if any provision of this Agreement is held to be invalid or unenforceable, such provision may be removed and the remaining provisions will be enforceable.

13.3 This Agreement sets out the entire understanding and agreement between You and Household Properties with respect to its subject matter.
